St. Cloud Technical and Community College established this procedure to comply with the Americans with Disabilities Act (ADA) Section 504 mandate that requires the college to “provide for prompt and equitable resolution of complaints alleging any action that would be prohibited.” Additionally, it is the policy of SCTCC to comply with the provisions of: The Americans with Disabilities Act of 1990, Section 504 of the Rehabilitation Act of 1973, The Minnesota State Board Policy 1B.4, and other federal, state, and local laws that give guidance regarding accessibility and disability in higher education. Discrimination of qualified individuals with disabilities based on their disability is strictly prohibited.
SCTCC shall make reasonable accommodations to ensure access to programs, services, and activities as required by law. Access means that a qualified individual with a disability will not be excluded from participation in or be denied the benefits of the services, programs, or activities, nor will the individual be subjected to discrimination. If a student feels that they have been discriminated against due to their disability or they feel that they have been denied accommodation(s), it is their right to file a grievance.
- The SCTCC Disability Discrimination/Non-Compliance Grievance Policy applies in situations when:

A student followed established processes/procedures to request reasonable accommodations for a documented disability and the request was denied or not provided.

The implementation of approved accommodations did not effectively create equity in the classroom for the student.

- Important Note: Grievance procedures must be filed/started within twenty (20) days of the incident. After twenty (20) days, it is the student’s responsibility to provide information/documentation that supports reasoning/consideration for the delay.

- Step 1: Students with a grievance/complaint are encouraged to first discuss the concern with involved parties directly, if possible, and to mutually agree upon a resolution.
- Step 2: If resolving the concern informally with the involved person is not possible, or a resolution cannot be made, a complaint may be brought forward to Accessibility Services in writing.
